Skippers Call for Shoalwater
Shelter...
Bob McCollouch of Mackay VMR reported To
TCP that he had talked to a Marine Safety Queensland representative
concerning the need for smaller vessels especially, to have shelter
in the Shoalwater area, regardless of official weather terminology
or military live firing exercises. I contacted Peter Irwin, Senior
Project Officer with MSQ who did confirm this good news. Effective
now, any skipper who determines that the safety of his vessel/crew
may be at risk, may use the anchorages in the Port Clinton area,
(south arm) Island Head Creek or Pearl bay if required. Vessels
must contact VMR Roslyn Bay during the day or Gladstone nights.
If out of range, Hay Point, Thirsty Sound or Mackay VMR may be
able to relay notice to the relevant authority. Let them know
you are there. Peter also stated that there is a radio repeater
being installed in the vicinity now but it wont be done
until its done! Well let you know. It is emphasised
that this is for genuine situations as determined by the master
of the craft. Its your call. |

MILITARY OVER RULES
SKIPPERS CALL

TCP has been informed by Paul Watson
that it IS NOT the skippers call according to the military. To
quote; "Defence will seek confirmation of each situation
from the Water Police and Coast Guard, and that if a false claim
for safe haven is discovered, Defence would take the action listed
in the Notice to Mariners about illegal access: Any person or
vessel found within these danger areas will be removed by Australian
Defence Force personnel or by Queensland Police. Any costs associated
with such removal will be borne by the owner, charterer, hirer
or agent of the watercraft. Offenders will be subject to criminal
prosecution and upon conviction a maximum penalty of 3 months
imprisonment and $500.00 fine may be imposed'."
Thus the Water Police will have the last
say. TCP will continue to investigate this and hope that in conjunction
with members of VMR, this may be resolved in a less frustrating
fashion. This is in direct contradiction to statements given
to TCP and VMR in past. |

The item below just came in and if you
are confused as to the conflict in statements between Qld and
defence.. well that makes several of us. Make of it what you
will. TCP will try to provide information as best we can but
prefer to not make judgments on it. But TCP is hopeful that this
portends a better understanding between the military and the
cruising fleet.

However, the Australian Defence Force recognises and acknowledges
the requirements for the safety of all mariners during bad weather.
Defence intends to continue its planned flying and live firing
activities; however it has modified their activities to guarantee
full safety. Defence appreciates the positive support of mariners
and requests that on cancellation of the current strong wind
warning all vessels depart Island Head Creek anchorage.

Mariners are advised that live firing activities will be conducted
in the marine component of Shoalwater Bay Training Area during
the period 7 April to 28 April 2008 inclusive. The marine danger
area will be closed for access from 0001 hours on the 7 April
2008 until 2359 hours on the 28 April 2008.
A Marine Danger Area extends to all waters within a 3 nautical
mile radius of the following point: Triangular Island - approximate
position latitude 22º 23.00' S longitude 150º 30.30'
E
This closure includes all the waters, creeks, beaches and other
areas within the declared marine danger area.
Mariners are directed not to enter the relevant area, pursuant
to regulation 205 of the Transport Operations (Marine Safety)
Regulation 2004. Mariners are further requested not to approach
within 500 meters of any military vessel involved in the exercise.
A new Defence Practice Area Shoalwater Bay has been
implemented by the Minister of Defence as of Monday 5 February
2007. The Defence Practice Area has been expanded and may be
inconsistent with the area currently represented on some available
marine charts and land maps. Points of contact for this notice

in the marine component of Shoalwater Bay training area during
the period Friday, 1 February 2008 till Monday, 11 February 2008
inclusive. The marine danger area will be closed for access from
0001 hours Friday, 1 February 2008 till 2359 hours Monday, 11
February 2008. A Marine Danger Area extends to all waters south
of the line defined by the following points: Oyster Creek latitude
22º 30.73' S, longitude 150º 26.34' E
East Creek latitude 22º 30.20' S, longitude 150º 33.89'
E
All waters, creeks, beaches and other areas within the declared
marine danger area are not available for access.
There will be safe anchorages available at Supply Bay, Island
Head Creek, Pearl Bay and Port Clinton during this closure. Any
person or vessel found within these danger areas will be removed
by Australian Defence Force personnel or by Queensland Police.
Any costs associated with such removal will be borne by the owner,
charterer, hirer or agent of the watercraft. Offenders will be
subject to criminal prosecution
and upon conviction a maximum penalty of 3 months imprisonment
and $500.00 fine may be imposed. A new Defence Practice Area

involved in the exercise. Vessels approaching within five hundred
(500) metres may be instructed to move away from the area by
the Regional Harbour Master (Gladstone). Mariners are advised
that failing to comply with a direction from the Harbour Master
is an offence, and a maximum penalty of two hundred (200) penalty

Mariners are advised that due to dangers of unexploded ordinance,
a New Marine Danger Area has been declared from 0500 hours on
the 12th May 2007 until 1900 hours 14th May 2007.
The New Danger Area is all waters within a 4 nautical mile radius
of Raynham Island, latitude 22° 15.97'S, longitude 150°
32.46'E.
The current Notice to Mariners 257 of 2007 will remain in force
beyond 14th May 2007 as it is unlikely that the entire task will
be completed during this period.
Any person or vessel found within this danger area will be removed
by Australian Defence Force personnel or by Queensland Police.
Any costs associated with such removal will be borne by the owner,
charterer, hirer or agent of the water craft. Offenders will

ACTIVITY: REGIONAL HARBOUR MASTER'S DIRECTION TO ALL SHIPS

Mariners are advised that pursuant to:
Transport Operations (Marine Safety) Act 1994
Section 86A - General Direction
Section 88 - Direction to Master about Operation of Ship
Transport Operations (Marine Safety) Regulation 2004
Section 190 - Report to Area VTS
This Direction applies, until further notice, to the masters
of all ships that are 10 metres or more
in length that are:
(i) underway and entering, or about to enter; or
(ii) at a berth, or at anchor in the Gladstone Pilotage Area
and are about to be operated in,
or leave;
the Gladstone Pilotage Area.
For the purposes of this Direction, the term "Gladstone
Pilotage Area" is defined in Schedule 5
of the Transport Operations (Marine Safety) Regulation 2004,
(refer to the following Gladstone
Pilotage Areas chartlet).
Action required:
The master of any ship to which this Direction applies must contact
"Gladstone Harbour Control" on VHF channel 13 prior
to entering,
departing from or operating in the Gladstone Pilotage Area.
It is an offence to fail to comply with the above Direction without
a reasonable excuse
(maximum penalty $15,000 for individuals and $75,000 for a corporation).
If you fail to comply
with the above Direction then prosecution action against you
may be commenced.
